PER® POINT SYSTEM Terms & Conditions

These Terms and Conditions (this “Agreement”) govern the PER® Point System (collectively, the “Program”). The Program is a loyalty program brought to you by Physicians’ Education Resource, LLC (“PER,” “we” or “us”). Any enrollment or use of a membership in the Program subjects the user (“you” or “Member”) to the provisions of this Agreement. By enrolling in the Program, you are agreeing to the Terms and Conditions set forth in this Agreement.

  1. Enrollment.  You will be enrolled into the Program after you opt-in the Program at: https://education.gotoper.com/profile. The Program is open to individuals who are at least the age of majority in their jurisdiction of residence.  You must reside in a jurisdiction that has not prohibited participation in point and/or loyalty programs similar to the Program.  These terms are void to the extent where prohibited by law. 
     
  2. Points. Once you are enrolled in the Program, you will receive one (1) point for each dollar that you spend on registration fees for live conferences that are offered by PER.  Points will be credited to a user’s account on the  first day of the live conference for which a user has registered and payment has been received by PER.  PER will not grant you with retroactive credit or points for purchases made prior to enrollment in the Program.  Points are non-transferable and may only be redeemed by and on behalf of Member. You may use them towards registration fees for future CME-certified conferences offered by PER. You can use points in combination with other discount codes.  The discount code will be applied to the registration fee prior to the use of points.  You will only earn points on the dollar amount that you pay and not on the amount that is discounted or points are applied toward. You may not use partial points or partial bundles of points.  Upon redemption, Member must use all points accumulated to date toward the applicable registration fee.   Any unused, unexpired points remaining may be carried forward toward future registration fees.

    Each point awarded under the Program will be redeemed as $.01 (USD) toward future PER registration fees.  We may, without notice to you, change the minimum amount of points required for redemption toward future conferences.  Points have no monetary value, and may not be redeemed for cash. Points will expire if after a period of three (3) years you have not registered for a CME-certified conference offered by PER. You are responsible for paying all applicable taxes, fees, and surcharges for products purchased upon redemption of points and for any tax consequences of your participation in the Program. 
     
  3. Reservation of Rights. PER has the right to terminate the Program at any time.  PER will endeavor to provide advance notice of any termination of the Program, but undertakes no obligation to do so.   PER may change the Program’s rules, regulations, benefits, conditions of participation or point levels for discounts, in whole or in part, at any time without notice. You may view the current version of this Agreement at any time at https://education.gotoper.com/about-per-point.
     
  4. Privacy.  PER takes your privacy seriously.  Please review our Privacy Policy at http://www.gotoper.com/privacy which explains how we handle personal data collected by PER, if any, via the Site.
     
  5. Cancellation. You may opt out of the Program at any time.  To opt out, please contact us info@gotoper.com.  In our sole discretion, we reserve the right to cancel your account.  Abuse of the Program, including failure to follow program policies and procedures, the sale or barter of points, and any misrepresentation of fact relating thereto or other improper conduct as determined by PER in its sole judgment, may result in cancellation of your account and future disqualification from program participation, and/or, but not limited to, forfeiture of all points accrued. In connection with the enforcement of any of the terms and conditions governing the Program, PER reserves the right to take appropriate legal action, as it deems necessary, and to recover damages, attorneys’ fees and court costs.
     
  6. Disclaimer and Limitation of Liability.  Your participation in the Program is exclusively at your own risk and the Program is provided to you AS-IS WITHOUT WARRANTY OF ANY KIND.  PER MAKES NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO THE USE OF THE PROGRAM AND THE MATERIALS CONTAINED HEREIN.  PER EXPRESSLY DISCLAIMS ANY EXPRESS OR IMPLIED WARRANTY, INCLUDING BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, QUIET ENJOYMENT OR NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.  PER DOES NOT WARRANT THAT (A) THE PROGRAM WILL MEET YOUR REQUIREMENTS AND/OR EXPECTATIONS; (B) BE ERROR-FREE, UNINTERRUPTED OR SECURE, (C) DEFECTS WILL BE CORRECTED, OR (D) ANY CONTENT OR INFORMATION ON THE PROGRAM IS CORRECT, RELIABLE, CURRENT OR COMPLETE.

    UNDER NO CIRCUMSTANCES SHALL PER, ITS SUBSIDIARIES, AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES OR AGENTS BE LIABLE FOR ANY DIRECT,INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES WHETHER IN AN ACTION IN CONTRACT OR TORT (INCLUDING NEGLIGENCE AND STRICT LIABILITY) RESULTING IN ANY WAY FROM THE PROGRAM OR YOUR PARTICIPATION IN THE PROGRAM OR ANY PER CONFERENCES OR ACTIVITIES, INCLUDING FROM PER’S PERFORMANCE OR ANY FAILURE TO PERFORM UNDER THE TERMS HEREOF, EVEN IF PER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.  TO THE FULLEST EXTENT PERMITTED BY LAW, YOU WAIVE AND RELEASE ANY CLAIMS TO SUCH DAMAGES.
     
  7. Miscellaneous. The Program is subject to all applicable federal, state, and local laws and regulations. Issues concerning the construction, validity, interpretation and enforceability of these Terms shall be governed by the laws of the State of New Jersey, without regard to any principles of conflict of laws. All disputes arising out of or connected with this Program will be resolved individually, and without resort to class action, exclusively by a state or federal court located in Middlesex County, New Jersey. Should there be a conflict between the laws of the State of New Jersey and any other laws, the conflict will be resolved in favor of the laws of the State of New Jersey.
